1. Scope
This Shipping & Delivery Policy applies to orders placed through namastedeutschland.de for delivery within Germany.
It supplements our General Terms and Conditions of Sale (AGB).
In the event of any conflict between this Shipping Policy and mandatory statutory provisions, the mandatory statutory provisions shall prevail.
Nothing in this Shipping Policy is intended to exclude or restrict mandatory statutory rights of consumers.
2. Shipping Area
Unless expressly stated otherwise in the respective product offer or checkout, we deliver within Germany.
Delivery restrictions applicable to individual products, delivery areas or shipping methods will be displayed on the website or during the ordering process where applicable.
We reserve the right not to accept an order where delivery to the requested destination is not reasonably possible, where carrier restrictions apply, or where we cannot reasonably arrange the requested delivery under the conditions stated in the offer.
This applies in particular to fresh, frozen and otherwise perishable products.
3. Germany-Wide Shipping Costs
For standard parcel delivery within Germany:
Orders of €49.00 or more
Standard shipping is free for orders with a merchandise value of at least €49.00, subject to the shipping conditions stated below.
Orders below €49.00
For orders with a merchandise value below €49.00, the standard shipping charge is:
€5.99
Parcel weight
The maximum standard parcel weight is generally 25 kg per box.
Where an order cannot reasonably be shipped in one parcel because of its weight, volume, product characteristics or carrier restrictions, we may divide the order into multiple parcels.
If an additional shipping charge would become payable because multiple parcels are required, that additional charge will not be imposed on a consumer without being disclosed and agreed before the relevant contractual commitment.
4. Free Local Delivery in Wolfsburg
For qualifying orders within our applicable Wolfsburg local-delivery area:
Orders of €49.00 or more qualify for free local delivery.
Availability of local delivery depends on the delivery address and operational delivery area.
Where local delivery is unavailable, the standard shipping conditions shown during checkout apply.
5. Shipping Providers
We normally use:
- DHL;
- DPD;
- Hermes; and/or
- another suitable parcel or logistics provider where necessary.
Unless a particular carrier has expressly become part of the contractual agreement, we may select the shipping provider at our reasonable discretion.
Selection may depend on:
- parcel weight;
- parcel dimensions;
- destination;
- carrier availability;
- product type;
- expected transit time;
- public holidays;
- operational requirements; and
- requirements intended to reduce unnecessary delays involving perishable products.
A customer is not entitled to shipment by a particular carrier unless a particular shipping method or carrier has expressly been agreed.
6. Order Processing
Our usual internal order-processing period is approximately:
1–2 working days
Working days are generally Monday to Friday, excluding applicable public holidays.
The processing period is separate from the carrier's transport period.
Processing may take longer where:
- payment has not been successfully received or authorised;
- information supplied by the customer is incomplete;
- an address requires clarification;
- an ordered product is temporarily unavailable;
- an order contains fresh or frozen products;
- a public holiday affects dispatch;
- an unusually high number of orders is being processed;
- carrier operations are disrupted; or
- delaying dispatch is reasonably necessary to avoid foreseeable weekend storage of perishable goods.
7. Estimated Transit Time
After a shipment is handed to the carrier, ordinary parcel delivery within Germany generally takes approximately:
2–3 working days
unless another delivery period is stated in the respective product offer or checkout.
Unless expressly described as a guaranteed or binding delivery date, transit-time indications are estimates.
Mandatory statutory rights concerning delivery and delay remain unaffected.
8. IMPORTANT – NO COLD-CHAIN DELIVERY
We do not provide refrigerated, continuously frozen, temperature-controlled or cold-chain parcel delivery unless a particular shipping option is expressly identified as such.
Frozen, fresh and other perishable products offered for standard parcel delivery are shipped through ordinary parcel logistics.
Accordingly:
We do not guarantee that a continuously refrigerated or frozen temperature will be maintained throughout transportation.
Customers should take this shipping method into account before purchasing fresh, frozen or otherwise temperature-sensitive products.
This disclosure describes the shipping service offered by us.
It does not exclude mandatory statutory rights where goods are defective, unsafe or otherwise not in conformity with the purchase contract at the legally relevant time.
9. Special Dispatch Schedule for Frozen, Fresh and Perishable Products
Orders containing one or more of the following are subject to special dispatch arrangements:
- frozen products;
- fresh fruit;
- fresh vegetables;
- fresh foods;
- chilled or temperature-sensitive foods; or
- other products particularly susceptible to deterioration.
The purpose of the special dispatch schedule is to reduce the risk that perishable goods remain within a parcel carrier's logistics network over a weekend or public holiday.
Orders ready for dispatch before Wednesday
Where operationally possible, orders containing perishable goods that have been successfully received, paid and processed sufficiently early may be dispatched during the first part of the working week.
Orders received on Wednesday or later
Orders containing frozen products and/or fresh fruit or vegetables that are received on Wednesday or later will normally be held and dispatched from Monday of the following week.
Public holidays and foreseeable delays
If Monday is a public holiday, or if we reasonably expect unusually long carrier delays, severe weather, operational disruption or another circumstance that creates a significantly increased risk of unnecessary transport delay, dispatch may take place on the next suitable working day.
Our right to delay dispatch before contractual acceptance
Where an order has not yet been contractually accepted by us in accordance with our General Terms and Conditions, we may decline or postpone acceptance if we reasonably consider the available shipping circumstances unsuitable for the product ordered.
This can include circumstances where the expected transit conditions may make proper delivery of a perishable product impracticable.
10. Mixed Orders
Where an order contains both:
- shelf-stable products; and
- fresh, frozen or otherwise perishable products,
we may apply the dispatch timetable for perishable products to the entire order.
Where appropriate, we may alternatively divide the order into separate shipments.
11. Customer's Responsibility for Correct Delivery Information
Customers must provide complete and accurate information necessary to complete delivery.
This includes, where applicable:
- full recipient name;
- street name;
- house number;
- postal code;
- city;
- apartment number;
- floor;
- company name;
- c/o information;
- doorbell/mailbox name;
- telephone number where required;
- parcel-shop identification information; and
- any other delivery information reasonably required by the carrier.
The customer should verify this information before submitting the order.
12. Changes to the Delivery Address
Customers should contact us immediately if they discover an error in their delivery address.
Before dispatch, we may be able to correct the information.
After the parcel has been transferred to the carrier, we cannot guarantee that an address change will still be possible.
We shall not be responsible for additional delay caused solely by incorrect or incomplete information provided by the customer, without prejudice to mandatory statutory rights.
13. Customer Cooperation for Perishable Deliveries
Customers ordering frozen, fresh or otherwise perishable products should take reasonable steps to enable timely delivery.
In particular, customers should:
- provide accurate delivery information;
- provide an identifiable recipient name;
- ensure the relevant name is displayed on the doorbell/mailbox where necessary;
- monitor tracking information;
- ensure that delivery can reasonably be accepted;
- follow carrier notifications;
- promptly collect parcels redirected to collection points; and
- promptly unpack and appropriately store perishable products following successful delivery.
These cooperation requirements do not shift statutory transport risk to a consumer where that risk legally remains with us.
14. Tracking Information
Where the shipping provider makes tracking information available, we will normally provide the tracking number or tracking link electronically.
Customers ordering perishable goods are strongly requested to monitor this information.
Tracking information may include:
- estimated delivery date;
- unsuccessful delivery attempt;
- delivery modification;
- delivery to a neighbour;
- collection-point delivery;
- parcel-shop availability;
- return to sender; and
- successful delivery.
Carrier tracking records may be retained by us where reasonably necessary for processing delivery complaints, defending legal claims or asserting claims against carriers or customers, subject to applicable data-protection law.
15. Delivery to Parcel Shops and Collection Points
Where supported by the carrier, a parcel may be delivered to or redirected to a:
- DHL collection point;
- Packstation;
- DPD Pickup parcel shop;
- Hermes ParcelShop; or
- another authorised collection location.
The collection period is determined by the relevant carrier.
We therefore do not guarantee a fixed universal collection period.
The customer must follow the deadline shown in the carrier's notification or Track & Trace information.
If the parcel is not collected within that period, the carrier may automatically return it to us.
16. Failed Delivery Attributable to the Customer
Delivery may fail for circumstances attributable to the customer, including where:
- an incorrect address was supplied;
- an incomplete address was supplied;
- the house number is incorrect;
- the postal code is incorrect;
- the recipient cannot be identified;
- the doorbell/mailbox name differs from the recipient information and prevents delivery;
- an incorrect parcel-shop identifier was supplied;
- the customer or authorised recipient unjustifiably refuses delivery;
- nobody is available to accept a shipment where personal acceptance is required;
- an age-restricted shipment cannot be handed over because the required conditions are not met;
- the customer fails to collect the parcel within the carrier's collection period; or
- another circumstance within the customer's sphere of responsibility prevents successful delivery.
Where the customer is responsible for the failed delivery, we reserve all rights available under applicable law.
17. Additional Costs Caused by Failed Delivery
Where delivery fails for circumstances attributable to the customer and this causes us additional costs, we reserve the right to claim reimbursement of reasonable additional costs to the extent permitted by law.
This may include, where legally recoverable:
- carrier return charges;
- additional postage;
- reasonable re-dispatch costs; and
- other losses demonstrably resulting from the customer's breach of contractual obligations.
We do not impose an automatic contractual penalty merely because delivery failed.
Where damages are claimed, the customer's statutory rights and defences remain unaffected.
18. Re-delivery
If a parcel is returned because of circumstances attributable to the customer and the customer requests shipment again, we may require payment of reasonable additional shipping costs before re-dispatching the order, insofar as legally permissible.
This does not apply where the unsuccessful delivery was attributable to us or to circumstances for which we legally bear responsibility.
19. Returned Perishable Products
Fresh, frozen and other perishable goods that have entered the carrier network and are subsequently returned may no longer be suitable for resale or re-dispatch.
For reasons of:
- food safety;
- hygiene;
- deterioration;
- traceability; and
- quality assurance,
we may dispose of returned perishable goods where appropriate.
A customer does not automatically obtain a right to re-delivery of the same physical perishable products.
The financial consequences of an unsuccessful delivery depend on the reason for the failure and the applicable statutory provisions.
20. Transport Risk for Consumers
Where the buyer is a consumer, statutory German rules concerning transport risk apply.
Where shipment is carried out using a carrier selected or offered by us, the risk of accidental loss or accidental deterioration is governed by the applicable provisions for consumer sales.
We do not seek through this Shipping Policy to transfer to consumers a transport risk that mandatory law places on us.
Different rules may apply where the consumer independently commissions a carrier not previously designated by us, where the statutory requirements are fulfilled.
21. Transport Risk for Business Customers
Where the customer is an entrepreneur, the statutory provisions applicable to commercial transactions and shipment apply.
Any additional B2B provisions in our General Terms and Conditions remain applicable.
22. Fresh Fruit and Vegetables – Natural Characteristics
Fruit and vegetables are natural agricultural products.
There may be natural differences in:
- colour;
- shape;
- weight;
- size;
- surface appearance;
- firmness;
- texture;
- degree of ripeness;
- sweetness;
- aroma; and
- other naturally occurring characteristics.
Minor natural variations that are normal for the relevant type of product do not by themselves constitute a defect.
Nothing in this provision prevents a customer from exercising statutory rights where the goods are actually defective.
23. Inspection Upon Delivery
Customers are requested to inspect the delivered products promptly after receipt.
This is particularly important for:
- fresh fruit;
- vegetables;
- frozen products;
- chilled products;
- products susceptible to leakage; and
- fragile products.
Customers should check:
- whether the order is complete;
- whether the parcel shows visible damage;
- whether any packaging is leaking;
- whether products are visibly damaged;
- whether fresh products show abnormal spoilage; and
- whether frozen products show significant deterioration.
For consumers, this is a request intended to facilitate rapid investigation and does not create a loss of mandatory statutory warranty rights merely because a consumer fails to report immediately.
24. Reporting Damaged, Spoiled or Missing Products
If there is a problem with a shipment, please contact us as soon as reasonably possible.
Please provide:
- your order number;
- a description of the problem;
- photographs of the outer parcel;
- a photograph showing the shipping label;
- photographs of visible damage to the parcel;
- photographs of affected products;
- photographs of internal packaging where relevant; and
- any relevant carrier information.
Please contact:
Prompt documentation helps us establish:
- when the damage occurred;
- whether it occurred during transport;
- whether it concerns an individual product or the whole shipment;
- whether the carrier may be responsible; and
- the appropriate remedy.
A consumer's mandatory statutory rights are not made dependent on providing photographs where such a condition would be legally impermissible.
25. Do Not Dispose of Evidence Immediately
Where reasonably possible, customers reporting transport damage are requested to retain:
- the damaged goods;
- external packaging;
- internal packaging;
- shipping label; and
- other relevant evidence
until we have had a reasonable opportunity to investigate the complaint.
For perishable goods, we do not require unsafe food to be retained where doing so would be unreasonable or create a hygiene risk.
Photographic documentation should therefore be made before disposal wherever reasonably possible.
26. Storage After Successful Delivery
After proper delivery, responsibility for appropriate storage and handling passes to the customer in accordance with applicable law.
Customers must follow the storage information supplied with or displayed on the relevant product.
Depending on the product, this may require:
- refrigeration;
- freezing;
- cool and dry storage;
- protection from sunlight; or
- consumption within a stated period.
We are not responsible for deterioration occurring after proper delivery insofar as that deterioration is caused by improper storage, unreasonable delay in unpacking, misuse, failure to follow storage instructions or another circumstance attributable to the customer.
This provision does not exclude liability for a defect that already existed at the legally relevant time.
27. Frozen Products After Delivery
Customers receiving frozen products should inspect them promptly and follow any product-specific storage and food-safety information.
Because our standard parcel shipment is not cold-chain delivery, the customer should make an appropriate food-safety assessment before refreezing or consuming a product that has thawed.
Nothing in this policy should be interpreted as advice to refreeze or consume a product where doing so would be unsafe.
28. Right of Withdrawal – Perishable Goods
Consumers generally have a statutory right of withdrawal for distance contracts unless a statutory exception applies.
In particular, the statutory right of withdrawal does not apply, subject to the legal requirements, to contracts for goods that can deteriorate quickly or whose expiry date would quickly be exceeded.
Whether this exception applies depends on the characteristics of the particular product.
The exception may therefore apply to certain:
- fresh fruits;
- vegetables;
- chilled foods;
- fresh foods; and
- other rapidly perishable products.
The absence of a statutory withdrawal right is not the same as the absence of warranty rights.
A customer may still have statutory rights where goods are defective.

29. Hygiene-Sealed Goods
Separate statutory restrictions on withdrawal may apply to sealed goods that are not suitable for return for health-protection or hygiene reasons once their seal has been removed after delivery.
Whether that exception applies depends on the individual product and statutory requirements.
30. Delayed Delivery
Delivery may occasionally be delayed because of circumstances including:
- carrier disruptions;
- severe weather;
- public holidays;
- strikes;
- traffic disruption;
- unusually high parcel volumes;
- incorrect customer information;
- force majeure or comparable exceptional events; and
- circumstances outside our reasonable control.
Mandatory statutory rights concerning delayed delivery remain unaffected.
31. Seller's Right to Avoid Unsuitable Perishable Dispatch Before Acceptance
Because we do not use a cold-chain delivery service, we may decide not to accept an order containing a perishable or temperature-sensitive product where, before contractual acceptance, we reasonably determine that available shipping conditions make the intended shipment unsuitable.
Where payment has already been collected but the order is not accepted, the relevant payment will be released, cancelled or refunded as applicable.
32. Complaints and Investigation
We reserve the right to investigate shipping and product complaints before determining the appropriate remedy.
Depending on the circumstances, we may review:
- customer-supplied evidence;
- carrier tracking records;
- delivery scans;
- GPS or delivery information available from the carrier;
- parcel weight;
- packing records;
- inventory records;
- product batch information;
- correspondence;
- photographs; and
- other reasonably relevant evidence.
Any statutory rights concerning remedies for defective goods remain unaffected.
33. Fraudulent or Abusive Claims
Nothing in this policy requires us to accept claims that are fraudulent, deliberately misleading or unsupported where applicable law does not require payment or another remedy.
We reserve all legal rights in cases involving suspected fraud, manipulation of evidence, deliberate false statements or abusive conduct.
This provision does not prejudice legitimate consumer complaints or statutory consumer rights.
